Required Disclosures and Addendums
Landlord/property manager identity disclosure
Under Alabama state law, § 35-9A-202, all rental agreements identify the landlord or property manager. The name of the landlord and address should be indicated. If not, the name and address of the person authorized to manage the real estate and carry out the service of the process must be indicated.
Lead-Based Paint Disclosure
(Title 42 U.S. Code § 4852(d)) requires the landlords to notify the tenants of the existence of lead-based paint on the premises. It is a requirement for all premises built before 1978. A lead disclosure form and an EPA pamphlet should be attached to the Alabama standard residential lease agreement.
The Alabama State law allows the landlord right to entry. However, they must follow (Ala. Code § § 35-9A-303) and give a minimum of two days’ notice before entry. The landlord is also allowed emergency entry without prior notice. This is in the case of serious health or safety issues, fire, or water leaks.

Alabama Security Deposit Laws
In Alabama, the landlords are allowed to ask for a maximum of one month’s rent as the security deposit. They are also allowed to ask for pet deposits as well as other additional fees. These provisions are stated in (Alabama Code § 35-9A-201).
The (§ 35-9A-201(b)) requires the landlord to return the deposit within 60 days after the termination of the lease agreement.

Can a landlord raise my rent in Alabama during the tenancy?
No. In Alabama, the landlords are prohibited to raise the rent during the rental lease term. It can however happen if the lease agreement states and allows them to do that.
Can a lease automatically renew in Alabama?
Yes. Most of the Alabama rental lease agreements automatically renew when the initial rental period lapse. The rental lease agreement now changes to a month-to-month agreement and a week-to-week agreement depending on the prior agreement.
Are late fees charged in Alabama?
Alabama State has no laws on late rent fees. If the Alabama rental lease agreement does not indicate late rent fees, the landlord cannot charge them. They are however required to give defaulters at least seven days’ notice to pay rent or vacate the premises.
Can I get evicted in Alabama?
Yes. The landlord can evict a tenant in Alabama as long as there is probable cause. The landlord cannot evict a tenant if there are no violations of any rules committed.
